Please read these terms carefully before using CloakedCare

Important Notice
These Terms of Service constitute a legally binding agreement between you and CloakedCare. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, do not use our services.
1. Acceptance of Terms
By creating an account, accessing, or using CloakedCare (the "Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
2. Eligibility
To use CloakedCare, you must:
- •Be at least 18 years of age
- •Have the legal capacity to enter into binding contracts
- •Not be prohibited from using the Platform under applicable laws
- •Provide accurate and complete information during registration
- •Complete identity verification if posting bills
By using CloakedCare, you represent and warrant that you meet all eligibility requirements.
3. User Accounts
Account Creation
You must create an account to use certain features. You agree to provide accurate, current, and complete information and keep your account information updated.
Account Security
You are responsible for:
- • Maintaining the confidentiality of your password
- • All activities that occur under your account
- • Notifying us immediately of unauthorized access
- • Not sharing your account credentials with others
Account Termination
You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks.
4. Identity Verification
All users who post bills must complete identity verification. By submitting verification documents, you:
- •Authorize us to verify your identity through third-party services
- •Represent that all submitted documents are authentic and unaltered
- •Agree that false information may result in account termination and legal action
- •Understand that verification does not guarantee bill funding
Verification documents are encrypted, securely stored, and used solely for identity verification purposes.
5. Posting Bills
Bill Requirements
Bills posted on CloakedCare must:
- • Be legitimate bills from recognized merchants
- • Include authentic documentation (statements, invoices)
- • Be for essential services or necessities
- • Have accurate amounts and due dates
- • Not be already paid or covered by other means
Category-Based Bill Upload Policy
You can upload one bill per category based on your subscription plan. Multiple bills can be active simultaneously as long as each is in a different category:
- • Basic Plan (3 categories): Water, Gas, Electricity
- • Standard Plan (6 categories): Basic categories + Internet, Phone, Trash
- • Full Care Plan (9 categories): Standard categories + Car Payment, Medical, Rent/Mortgage
Once a bill in a specific category is fully funded, paid, or archived, that category slot becomes available for a new bill.
Bill Representations
By posting a bill, you represent that:
- • All information provided is truthful and accurate
- • You are legally responsible for the bill
- • The bill has not been posted on other platforms simultaneously
- • You will use funds solely for the stated purpose
6. Fees and Payment Structure
For Bill Posters
If you post bills, you agree to pay:
- • Monthly subscription fee based on your selected plan tier (Basic is Free, Standard $10/month, or Full Care $20/month)
- • Subscription fees are billed monthly and are non-refundable
- • You may cancel your subscription at any time; access continues until the end of the current billing period
- • Failed payments will temporarily block bill uploads until payment is resolved, but your account remains fully accessible
- • Your existing bills and account features remain available during payment issues
For Donors
When you make a donation, you agree to pay:
- • Donation Amount: The amount you choose to contribute toward a bill (100% goes to the merchant)
- • Platform Fee: 5% of the donation amount, added on top, to cover platform operations, fraud prevention, verification systems, secure payment processing, and security
- • Optional Tip: You may voluntarily add a tip to provide additional support to CloakedCare operations (completely optional)
Fee Example:
If you donate $100 to a bill:
- • Donation to bill: $100.00
- • Platform fee (5%): $5.00
- • Total charged: $105.00
- • Amount bill receives: $100.00
Fee Transparency
All fees are clearly disclosed before you complete a donation. By proceeding with a donation, you acknowledge and accept the total amount charged, including all fees. Both donations and fees are non-refundable under any circumstances once the transaction is processed.
7. Making Donations
Donation Terms
When you make a donation:
- • Donations are voluntary contributions with no expectation of return
- • All donations are final and non-refundable once processed
- • Donations are promptly allocated to bills and cannot be reversed or refunded
- • You authorize us to send payment directly to the bill merchant on behalf of the bill poster
- • Donations are not tax-deductible (CloakedCare is not a 501(c)(3) organization)
- • You agree to pay the total amount including donation and platform fee
Payment Processing
Donations are processed through Stripe, a third-party payment processor. By making a donation, you agree to Stripe's terms and authorize the total charge including all fees. The 5% platform fee covers secure payment processing and is paid by you in addition to your donation amount.
No Guarantee of Use
While we implement verification and anti-fraud measures, we cannot guarantee that all bills are legitimate or that payments will be applied as stated. Donations are made at your own risk.
8. Prohibited Activities
You agree not to:
Fraud & Misrepresentation
- • Post false or misleading bills
- • Use fake or stolen identity documents
- • Misrepresent your financial situation
- • Post the same bill on multiple platforms
System Abuse
- • Create multiple accounts to circumvent rules
- • Manipulate or exploit platform features
- • Use automated tools or bots
- • Attempt to access others' accounts
Illegal Activities
- • Violate any applicable laws or regulations
- • Engage in money laundering
- • Use platform for illegal purposes
- • Infringe on intellectual property rights
Harmful Conduct
- • Harass, threaten, or abuse other users
- • Post offensive or inappropriate content
- • Distribute malware or viruses
- • Interfere with platform operations
Violation of these prohibitions may result in immediate account termination, forfeiture of funds, and legal action.
9. Payment Processing to Creditors
Once a bill reaches its funding goal, CloakedCare works to process payment to the merchant as soon as possible, typically within 1-2 business days. By using the Platform, you understand that:
- • Payment timing depends on merchant processing times
- • Some merchants may not accept third-party payments
- • We are not responsible for merchant errors or delays
- • Bill locking prevents overpayment once goal is reached
- • Partial funding may be accepted at bill poster's discretion
10. Intellectual Property
Platform Content
All content on CloakedCare, including text, graphics, logos, software, and design elements, is owned by CloakedCare or its licensors and protected by copyright, trademark, and other intellectual property laws.
User-Generated Content
You retain ownership of content you post (bills, stories, messages). By posting content, you grant CloakedCare a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for platform operation purposes.
Restrictions
You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform without our express written permission.
11. Disclaimers & Limitations of Liability
Platform "As Is"
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Guarantee
We do not guarantee that bills will be funded, that the Platform will be error-free or uninterrupted, or that all users are honest. We make no representations about the accuracy of user-provided information.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOAKEDCARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM.
12. Indemnification
You agree to indemnify, defend, and hold harmless CloakedCare, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- • Your use of the Platform
- • Your violation of these Terms
- • Your violation of any rights of another party
- • Any content you post on the Platform
13. Dispute Resolution
Informal Resolution
Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. Contact us through our Contact page with details of the dispute.
Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.
Governing Law
These Terms are governed by the laws of the United States and the State of [State], without regard to conflict of law principles.
14. Termination
We reserve the right to suspend or terminate your account at any time for:
- • Violation of these Terms
- • Fraudulent activity or misrepresentation
- • Risk to platform security or integrity
- • Extended period of inactivity
- • Any reason at our sole discretion
Upon termination, your right to use the Platform immediately ceases. Sections of these Terms that by their nature should survive termination shall survive.
